Abstract

Ports are one of the foundations and core of China’s national strategy
regarding the 21st century Maritime Silk Road, structuring its overseas assistance
and influence, having significant strategic value and practical significance.
Therefore, from the unique perspective of the port industry, this article carefully
scrutinizes the opportunities and risks of the implementation of China’s 21st
Century Maritime Silk Road and puts forward the idea of developing an
international law based construct for the construction of strategic port networks
construction under its umbrella. The main innovations of this study are as follows.
First, this paper analyses the current layout of China's domestic port network as
well as its strategic investments or work in overseas ports;it then puts forward
the legal dilemma of the 21st century Maritime Silk Road;finally to puts forward
the construction idea of a legal basis of China's overseas strategic port network
interests and participations.
